Indemnity Waiver for Riding an ATV, Electric Bicycle or Scooter

I, [                                        ], hereby acknowledge and agree that by renting and riding an ATV, electric bicycle or scooter from 2304322 Ontario Inc. also known as Beautiful Curacao (hereinafter referred to as the “Company”), I am assuming certain risks and responsibilities. I understand that the use of an ATV, electric bicycle or scooter involves risks, including the risk of property damage, personal injury, or death.

In consideration of being allowed to rent and ride an ATV, electric bicycle or scooter, I hereby release, indemnify and hold harmless the Company, its owners, employees, agents, and affiliates from any and all claims, damages, liabilities, costs or expenses arising out of my rental and use of the ATV, electric bicycle or scooter, whether caused by the negligence of the Company, its owners, employees, agents, or affiliates, or otherwise.

I acknowledge that I have heard and read the Company's safety guidelines and operating instructions, and that I will abide by all the rules and regulations set forth therein. I understand that I am solely responsible for any damages to the ATV, electric bicycle or scooter, or to any property or person, caused by my negligent, willful or intentional conduct.

I agree to indemnify and hold harmless the Company, its owners, employees, agents, and affiliates from any and all claims, damages, liabilities, costs or expenses, including but not limited to attorneys’ fees and court costs, arising out of or related to my rental and use of the ATV, electric bicycle or scooter.

I further acknowledge and agree that this indemnity waiver is binding and enforceable under the law of Curacao. I have read this waiver, fully understand its terms, and agree to its provisions. I am aware that by signing this waiver, I am giving up certain legal rights and remedies, and I sign it freely and voluntarily without any inducement, assurance or guarantee being made to me and without relying on any statements or representations made by the Company or its representatives.
