Indemnity Waiver for Riding an ATV, Electric Bicycle or Scooter

I, [                                                                  ] and passenger [                                                                   ] hereby acknowledge and agree that by renting and riding an ATV, electric bicycle, or scooter from 2304322 Ontario Inc., also known as Beautiful Curacao (hereinafter referred to as the “Company”), I (we) assume certain risks and responsibilities. I (we) understand that the use of an ATV, electric bicycle, or scooter involves inherent risks, including property damage, personal injury, or death.

In consideration of being allowed to rent and ride an ATV, electric bicycle, or scooter, I (we) hereby release, indemnify, and hold harmless the Company, its owners, employees, agents, and affiliates from any and all claims, damages, liabilities, costs, or expenses arising out of the rental and use of the ATV, electric bicycle, or scooter, whether caused by the negligence of the Company, its owners, employees, agents, or affiliates, or otherwise.

I (we) acknowledge that I (we) have read and understood the Company’s safety guidelines and operating instructions and agree to abide by all the rules and regulations provided. I (we) further understand that I (we) are solely responsible for any damages to the ATV, electric bicycle, or scooter, or to any property or person, caused by my (our) negligent, willful, or intentional conduct.

I (we) agree to indemnify and hold harmless the Company, its owners, employees, agents, and affiliates from any and all claims, damages, liabilities, costs, or expenses, including but not limited to attorneys’ fees and court costs, arising out of or related to the rental and use of the ATV, electric bicycle, or scooter.

Mandatory Identification Requirement
I (we) further acknowledge and agree that before being allowed to participate, I (we) will provide valid identification, including a driver’s license and passport, which the Company may record for identification and security purposes.

I (we) further acknowledge and agree that this indemnity waiver is binding and enforceable under the law of Curacao. I (we) confirm that I (we) have read this waiver, fully understand its terms, and agree to its provisions. I (we) am aware that by signing this waiver, I (we) are giving up certain legal rights and remedies. I (we) confirm that I (we) sign this waiver freely and voluntarily, without inducement, assurance, or guarantee made by the Company or its representatives.
